About this subject
At the completion of this subject students will be able to:
- discuss the application of critical elements of the Australian legal system with reference to the construction industry, and examine concepts of the contract and torts law and their application to case studies from the construction industry
- describe the impact of legislation on a variety of procurement strategies used in the construction industry, and explain how the law shapes dispute resolution methodologies commonly used in the industry
- identify and assess the competing priorities of time, cost, quality and risk mitigation to determine the most appropriate form of project procurement strategy/strategies for a specific project.

This subject introduces students to sources of law affecting building projects (including the judicial system, common and statute law, contract law, torts and dispute resolution) in relation to the various types of contracts available for project delivery. In teaching students how to utilise their knowledge of construction law and contracts in relation to the various types of procurement strategies, contracts and dispute resolution strategies/methodologies, this unit also aims to enable students to learn how to assess, highlight and address the competing priorities of time, cost, quality, risk transfer and risk mitigation to determine the most appropriate form of project procurement strategies for a specific project.
